I am a tenant is a 2nd floor flat. My bath overran sometimes ago, damaging the carpet in the bathroom. Unfortunately two flat below mine also have their ceiling damaged and requiring redecoration. My initial reaction was to accept responsibility for the repair of the floors of the flat I am renting and of flats downstairs.
However, when I set out to replace the carpet in my flat's carpet, I noticed a gaping hole on the floor with drainage pipes protruding. Apparently the builder's merely laid carpets over a floor that have hole in them.
My thinking is that it is fair enough that I replace the carpet in my flat but,as the overflowing water would not have gone through to flats below had the floor been done up to standard, the landlord or his builders through the NHBC cover (this is a new build) should be responsible for the repair of flats below.
I should mention again that my initial response was to accept responsibility for repairs, but having seen the standard of ward on the bathroom's floor, I have been having a feeling that the builders should take some responsibility here. Am I right?
I thought I should add more details here. I see that some guys here are not from the UK.
New buildings in the UK have a national builders insurance for 10 years against stuff like bad workmanship. Yes, it was a badass of a hole. You can Definitely pour a cup of water through it to the flat below.
I had originally accepted full responsibilities for the repairs.. BTW, the hole by the corner on the floor was discovered while I was replacing the carpet on my floor. I have shown it to the landlord who was thinking of asking the NHBC to come in to repair the floor. That is an admission of bad workmanship and my reasoning is that, in as much as I had accepted responsibility, damages from my bath would have been contained within my flat had the floor been made properly.
