Should I fight for my rent deposit?




Carpet Floors - the soft and comfortable side of living.

My deposit was £550, my letting agent is saying that the landlord had to pay £738 for "damage" when I left but the landlord will settle for just the £550, unless I disagree in which case he will push for the full amount.
The bill is as follows:
£60 for cleaning the oven (I left it cleaner than it was when I moved in!)
£178 for replacing the carpet (the carpet wasn't perfect when I moved in but there were some marks from being there for 4 years that I couldn't get out so fair enough)
£500 for redecorating.
My main problem is with the redecorating, I had a condensation problem in the flat which I believe wasn't my fault. There was no central heating and the electric heaters on the wall were not very effective so I used a plug in one - and I still could not keep the place very warm because the windows were not fitted properly (double glazed but my blinds moved when it was windy!) and the flat was very draughty in general.
So there was mould on the walls, especially behind where my furniture was. I was scared to get rid of it because the walls were not painted (they were covered with something that was beige and dusty, it rubbed off very easily when I had cleaned mould off before exposing grey plaster underneath) so I asked my letting agent what to do as I didn't want to expose more plaster. They said I should clean it off anyway.
So I cleaned it off, lots of plaster was exposed and I went to the letting agent and offered to repaint the entire flat. The told me not to incase the mould comes back.
So now I have a £500 decorating bill on my head, is this right? I really want to fight for my deposit but I don't want to risk losing my deposit and getting charged extra.

Marianne - Thanks for the advice, unfortunately I have nothing in writing, I'm not usually the type to complain but I've learned my lesson now! I pointed it out them verbally and they told me to ventilate the place more, which I did.

sharebearvicki - Thanks for your answer, my tenancy started before the DPS scheme came in (I moved in Nov 2006) so it would have to go straight to court, unfortunately I don't have any evidence but in the same vein, I don't see what evidence the landlord could have against me. Did you to court? And if so, what evidence did you use?

meerkat - I keep asking for official receipts, they just have the costs written down. I will ask for them in writing and save a copy of the letter.
