Can I get some general advice please.
I own an apartment in a communal building comprising of commercial units on the ground floor, and 2 levels of residential units on the first and second floors. The building is 4 years old and the roof has a mixture of pitches and troughs, i.e. valley gutters.
I am in dispute with the developer/owner of the entire building who claims there is nothing wrong with the roof. A summary of issues over the past year and beyond follow :-
1) Over the past year, water has penetrated into 4 of the 6 flats on the top floor of the building.
2) Two separate roofing companies have advised that all of the (extractor fan) vents on the roof have not been sealed correctly and that there is evidence of silicone and 'quick fixes'.
3) There is flashband around areas where leaks were discovered, i.e. this was added as a temporary fix to stop the water getting in and needs to be corrected permanently presumably with lead?
4) Numerous tiles have 'blown off' the roof and have to be replaced several times a year.
5) The guttering has fallen down twice this year alone.
6) Bills for roof repairs over the past few years run into several thousand pounds are are charged to the owners of the flats and commercial units via the yearly maintenance.
7) Building insurance will no longer accept claims regarding the roof as they are now suspicious.
8) The valley gutters have also leaked water into my flat.
I was strongly advised by one of the roofing companies who undertook a series of repairs earlier this year to get in touch with the NHBC/NFRC and get an independent roofing survey done. I requested this via our managing agent who asked another roofing company to go up there and 'take a look'. There are numerous photos, which the developer/owner of the building will not share. I have asked for these numerous times and he is clearly trying to hide something.
I am trying to establish the correct procedure to deal with these issues. I have a meeting with Citizens Advice next week, but I would appreciate some advice before that.
There is a (Premier) guarantee of 10 years for 'structural damage' which I need to examine in more detail to see what we are covered for. The building insurance company have confirmed that there are numerous claims going through/have gone through regarding the roof, but they will not send details due to data protection. I also have copy invoices from all roofing repairs for this year and there are lots. I have spoken to the NFRC who confirmed that the original roofing sub-contractor was not on their list so could not help. I have spoken to Building Control who said they were not interested as the building was over 1 year old, although they did say that tiles should not be coming off at all.
The developer/owner of the building is trying to sweep things under the carpet and claim there is nothing wrong when we know there is. A fellow owner of a property in the building is a solicitor who is on my side. My intention is to find out the correct procedure(s) to follow and then go to the solicitor for legal assistance if required.
