4)Sanjay has worked for the last 5 years for KarpetKleen Ltd ('KK), a company which cleans carpets. He has a written agreement with KK entitled 'Self-employed contractor's agreement'. The company deducts income tax and national insurance from his wages, and provides all the necessary equipment. He uses a company van. He receives no company sick pay if he is ill and has no company pension. He is expected to report for work every day to the company office where he is given work for the day. His normal hours of work are from 9.00am ? 5.00pm. He is not subject to the same disciplinary procedures as the office and administrative staff of KK. There is a term in his agreement which states that if he is unable to attend work at any time he may arrange at his own expense for another suitable person to do the job.
Using relevant case law,advise Sanjay whether he has the status of an employee for the purpose of exercising employment rights.
