My mother fell over at work a couple of weeks ago now. She works in a care home for the elderly. She is not exactly sure how she managed it, but she was pushing somebody along in a wheelchair. She walked over part of the floor where the carpet joins the floor and just fell. She fell in a very awkward way and has fractures in 3 places (including her front pubic bone and part of the back).
She is now wheelchair bound and unable to work there again for at least three months (if ever). She is currently in a long-stay small community NHS hospital. She's slowly being given physio to get her moving again, but won't be able to walk again until after her appointment at the main hospital which is another 4 weeks away yet.
Obviously she is currently only getting stat. sick pay from the government which works out at only around £80.00 per week (barely enough to cover the mortgage, let alone the other bills).
She is not sure how the accident happened. She does not think the area she fell is actually dodgy or a trip hazard. It all happened so fast.
Does she have a right to claim anything? She'd rather not have to go through court if possible. I've heard lots of conflicting advice from different people, some of whom say that she is entitled to try and get a settlement out of court from the employer's liability insurance.
Any advice on this, and how to proceed would be great. Thanks.
Just to explain, since people seem to be under the impression she's trying to claim money she's not owed:
All I'm asking is if there's anything she could claim, as she's not the most wealthy person in the world and she feels the need to know her rights. 'It's nobody elses fault but her own for not looking where she's going' is NOT helpful.
