Hi, so backstory:
I moved into a flat six months ago. The landlord told me that I would need to keep the place ventilated in order to avoid mildew etc. I have been doing that, however with the winter months coming in I haven't been able to do so as much. In one room, there is damp in one corner and discolouration of the carpet. I had my baby's cot in this room (recently I noticed this room was quite cold) so the other day I was taking apart his cot to move him into a different, warmer room. The underside of the cot mattress had a large patch of mould, so did the bottom of the rails of the cot. I also noticed one of his toys which has some fabric surround had a lot of mildew, so did the fabric edge of his changing mat. I took pictures of the mould, cleaned it up and contacted the landlord and told him because of this I would not be renewing my lease. He's just been with his wife and they have told me that the mould is entirely my fault for not ventilating properly and not using the dehumidifier. I try to heat the place every evening. Using the dehumidifier is completely impractical as I would have to carry it from room to room as the clothes are drying and it is also quite heavy and noisy. In my view, the growth of mould is outside of my control as it happened in one room only. What are my rights? I want him to replace the mattress, the other things are trivial. It's going to cost me £80 which is a cost I could really do without right now. Any advice would be really appreciated.
My option right now is to get the health visitor to write him a letter, saying obvious things like not safe for baby, etc. I foresee a fight, probably small claims court of something, so could I do all that after I get my deposit back?
