At the beginning of January my baby niece died of a Group B Strep.
My brother (B) and sister-in-law (SIL), were obviously devastated as were the rest of our family.
My B and SIL were renting a flat and asked the landlord if they could break their agreement early under the circumstances as it was too painful for them to stay there with the sad memories, he agreed.
At the time he had no issues and mentioned nothing regarding extra costs.
The landlord himself claims to live in Cyprus, so he sent his father to the flat on they day they left to check everything over and pick up the keys from from my B and SIL.
The day his dad came to pick up the keys up from my B and SIL, he looked everything over and told them that he was more than happy with the condition of the flat and would tell his son the same.
Roughly a week later my B and SIL chased the landlord, via text with regards to releasing their deposit, based on his father's observations. He then responded that the flat was left in a filthy condition and that his MOTHER had spent 8 hours cleaning that day to sort the flat out.
**gasp**
They responded to the landlord, that the problems must have happened whilst the agents were in control of the keys and asked for a full itemised list of the problems, he advised he would send it the next day.
The following day my B and SIL received an email detailing that 4 items (iron, ironing board, hoover & light) were missing from the flat, although my B andf SIL have their own of these items and have their receipts and no inventory was ever offered by the landlord.
As my B and SIL had moved there from a previously smaller rented flat (moving due to baby's birth) they had their own sofa's so they stored the landlords at my parents 3 bed house in their spare room, he claimed that there were stains all over the sofa's although no-one had so much at sat on them.
There are also other numerous things he claims were cleaned: carpet, windows,oven - the list goes on.
He is now claiming that he doesnt have any pictures of any of the so-called "missing" items or damaged carpet, sofa before they were cleaned. And is now claming that "professional" cleaners were called in to rectify the problems - when he had previously said it was his mother.
He has also said that now he gone to a different estate agent than the one that my B and SIL were with, that they have to pay the costs for that and that he is not going to refund their £950 deposit.
My B and SIL have asked him to send a copy of the so called professional cleaning receipt and also of course to explain why he father happily took the keys back with no mention of any problems, and also why he did not allow them the opportunity to meet somone back at the flat, to agree face to face the so-called problems.
Of course not even 2 months after the death of their 23 day old baby this is the last thing they need, if we dont hear the right noises back from the landlord, my B and SIL will apply to small claims court - but any additional help would be greatly appreciated!!
