I got the keys for my new property on the 2nd june this year i did not move into the property until the 23rd of june as there was repairs to be done. Such as doors hanging off, no gas safe certificate, fitted cooker unable to use, loose carpets, door handles missing, wooden flooring loose and springy, doors missing and faulty boiler. My Landlord when repeatedly asked if the reapirs could be done stated that he had other empty properies that he wnted to rent and that they took priority.
I had still not reached any conclusion so i contacted the enviromental health about the repairs they visited on the 3rd of August. There is 3 category A hazards nad 9 Category 2 Hazards in the property. I have also had a visit form the Fire Brigade who said if we have a fire we would be lucky to survive as the doors are hanging off missing or just do not shut preoperly. The Improvement Notice has not been served yet as the Enviromental Health have been extremely busy although i have now been served with a Section 21 notice which ends on the 2nd of December.
My bond has not been guaranteed and also the Landlord has been intimidating towards me making comments and making me feel uncomfortable in this house.
I have been offered a property with the council now but my Landlord has to write me a letter saying he is happy toleave. Which he wont do the council have rang him to see if he would talk to them and now it has had to go to management level to approve(i imagine this is to say no).
I do have rent arrears as i claim Housing Benefit at the minute my first application was mislaid and this had my Tenancy Agreement in it and aslo other details. My Lanadlord has refused to let me have another tenancy agreement and i have explained on numerous occasions that if i do not receive this then icannot get his rent.
I thought he would just let me leave as it will cost him money for me to stay as i cannot pay him rent and he will have to evict me form property and soireally thought he would let me leave. Also he has made accusations saying that i have ripped radiators off the wall and damaged the property which have found to be lies.
The thing is iwould really like to just move now and accept the council property and i would like any advice of who can go tohelp as i feel it is unfair for me lose this due to my current landlord being an idiot.
I have already contacted my local councillor and she just went to the council that i was offered my property by and came back and said i need the letter form landlord.
I thought about contacting the paper but when i mentioned this to my local councillor she said be careful. What i dont understand is that my lanlord intens to make me homeless soon anyway so then i can make a homeless application which they will then give me a council house.
I have 1 child of my own and i have my 2 nephews live with me. These are under the social services is there anything they can do to help me get this house.
My Landlord initially agreed for me to leave early with the Enviromental Health, as some of the roms can be blocked off from use the Enviromental Health will not class the house as uninhabitable.
If i cannot get the tenancy agreement then i will not be able to pay his rent i ahev been in touch with a solicitor about this matter and they have said the courts will usually say that i am not liable as since i have rewuested the tenanacy agreement by phone and letter.
I am desperate to move.My landlord told the solicitor i initially contacted to sort the issue of the repairs out that the reason i had no heating and hot water was due to me ripping the radiators off the wall and not due to the boiler being faulty. As i didnt have a current gas safety certificate i turned it off.
This was sorted out 30th of September. The boiler was found to be faulty and had to have new repairs. My landlord hasmade false allegationsabout me and i do not believe that contacting the landlord to see when repairs are being done counts as me harassing him.
Also one time he came round after i contacted enviromental health he knocked on the door i answered and he pushed the door so hard it hit my nephew in the back. i reported this matter to the police.
The radiators did not come off the walls the landlord said this as an excuse for no heating and it was false the EH made a report to this fact stating the landlord lied.
On the matter of the health hazards your right i should have never have signed the agreement at the time the LL said that he would get someone to fix all the things the following day and like an idiot ibelieved him. I needed a bigger property or the social services would not let my Nephews come and live with me or they would go into care.
