Me and my partner and two cats moved into our landlords house, he owned the entire thing but had split the top floor and bottom and added on another front door to make it two houses (illegally we recently found out). We shared the same electrictiy etc so we rent and bills were included. We had planned to live there till the end of univeristy, in two years time which the landlord was happy with. Then two weeks ago he comes in and says he needs us to leave by the Monday (this was on a thursday) saying a woman was coming over to see the wall he had built and if we did stay longer she'd ask us to leave anyway because he'd done it all without planning permission so it was all illegal. So by the monday we had moved to a new house, it was very inconvienent for us and a lot of trouble. We had stayed there a year and about 3 or 4 months. We had to share the dryer which was in our part of the house so the landlord had access to come in and use it, but before we knew it and for the entire time we were there on a regular basis he would come into our house with no notice and yell up for either us, he sometimes woke us up in the morning, late at night. he would not knock, just walk in and call us loudly till we answered. now we have left and because he kicked us out without notice i want to do something about it, not only that but because he has been unfair with giving us our deposit back. when we first moved my partner dropped the iron on the carpet one day, we apologized and offered at the time as we had the money to put laminate down, he said not to worry about it and he would sort it, as he changed the carpet every three years anyway. now we have left he said we agreed, which he doesnt have in writing and we certainly don't recall it, that he would take £100 off the deposit to replace the carpet, he then took another £45 so he could get the carpet cleaned which doesnt make sense if he's already taken 100 off. the carpet was cream, so obviously after that long living there it's not brand new looking anymore but that would come under general wear & tear. he offered first to give us 400 back from our 500 deposit after we told him about one of the chairs that broke etc. so that was agreed, we ended up with 315 back as i said he took an extra 45 for the carpet clean and then later said he was taking off more for the chairs because the ones he had in the house you can only buy in twos, but we only broke one so shouldnt have to pay for two! (we also repaired the chair too as best as we could. no one is going to live in there now anyway as it is illegal to do so. I want to know if I have good enough grounds to take him to court, I can't fit everything in here so if more information is needed, please let me know.
The reason I mentioned the coming in was because a landlord by law must give 24 hours notice to enetering the apartment, where as he just consistently walked into our home, We also did not get a months written notice to leave the place, instead we just got 4 days to move out which we now know he was not allowed to do. We're both students so we'd be able to go to the small claims court and solicters etc are free for us. He's broken the law more than once now and it has effected each time.
Pauline we were tentants, if we had been lodgers then it would have not been illegal for him to allow people to live in the top of the house but because we were tentants, we had our own front door and a wall seperating the the house and splitting it into two houses it was illegal to allow us to live there as tentants. The whole illegal house splitting thing is a bit complicated. The contract poses another problem, like I said we moved there feb last year about the 14th I think and we had a contract then but before we signed it he came up one day and said, you know don't worry about the contract, i'm cool with you and if you're cool with me it should be okay. It was the first time for moving somewhere from home etc so we were kind of new to everything so we just thought, sure that sounds fine and left it. So we can't use the contract against him as there is none but still as a landlord (he rents out a few other places) he still has to follow the general rules of notice etc.
Oh and the reason he wanted us out by that Monday so was the woman who was coming to check out the wall and ask for is to be removed wouldn't know he had people living there.
