In February this year we moved out of our flat. We received a letter from the deposit protection agency saying that our landlord wanted to retain £475.00 of our £500.00 deposit. They claimed this was for re-painting the whole house, carpet cleaning and oven cleaning. We completely disagreed with this. We had done a few touch ups around the house which we felt didn't warrant a full repaint. We therefore disputed this with the DPS. In the end we agreed to pay half towards the work (which we still felt was too much) so only received back £262.50 in the end.
My cousin happened to move into the house next. Still to this day they have not repainted the house, had the carpets cleaned or had the oven cleaned. My cousin is now leaving the house and when they came round to do the inventory check, she asked them when they were going to do the work in the house that i paid for out of my deposit. The estate agency have said that the Landlord is refusing to get the work done because she didn't agree with the outcome of our dispute and is refusing to pay half towards getting the work done.
My question is, shouldn't i be entitled to my money back if she is not getting the work done? In theory she has taken money from me in order to get work done, isn't this kind of stealing from me...like fraud or something?
