My self & my husband have been renting and living in the house we live in for 5 years now. We have 3 children 2 sons with special need and 1 baby girl. Up until August last year we had always paid are rent on time and had never missed a payment. Then At the end of august beginning of September last year my husband lost his job. And so money was very tight. I wasn't working as My sons have special needs and need round the clock care. It took my husband several months to find a new job. In this time my husband didn't have a job he did a bit of part time and temping work and so did I. We did what ever work we could find. But it wasn't enough and we fell behind in our rent. By november last year my husband had found another job and we slowly started to sort things out. We contacted agency and landlord and agreed to pay an extra amount per month on top of normal rent to pay off what we owe.( we have this agreement in writing). Then in january our car died and we had to use some of rent money to get another car. A car was very important to us as we needed a car to get our sons to hospital appointments and I was due to give birth to our 3 child any time and we needed to be able to get to hospital. So this was a set back. Then in February I was rushed in to hospital with complications with pregnancy and ended up very ill in intensive care. even after baby was born. It took several months for me recover fully. In this time my husband had to cut his work hours down abit to look after the children and me this again made money tight. Since April we have paid every rent on time plus the extra we agreed to pay on top. But this month my husband was paid late. So we have ended up paying rent late. Because we paid rent this month late agency have started to get funny and sent us a threatening letter stating that they want this months rent and the whole amount that we owe by wednesday or they will take further action and throw us out. They are coming to the house on wednesday afternoon. There is no way we can find this amount of money by wednesday. This months rent plus the extra which we have sent was £575 and we are in arrears of 600. that equals 1175. My husbands wages this month are only 1350. If we pay the other £600 we owe, the money we have left won't even cover the council tax let alone the other bills and food and nappies. We don't know what to do. We are terrified of loosing are home. The months that we have fallen behind in rent we have sent some money. There has never been any month when we did not send any money. And we have stuck to what we agreed with agency and have paid the extra on top of normal rent. We have continually communicated with the agency to let them know what is going on. We don't know what else we can do. Can any one give us any advice on where we stand and what we should do. Can they just throw us out. The thing that really annoys us is that when we moved in to this house that we are living in it was in a terrible state but was the only house available in the village where my husband had work, so we had no choice. The house was practically in habitable. the carpets had big holes in them and were soaked in dog urine from the people be fores dogs and the walls were so dirty they looked black. We asked the land lord to change the carpets and paint the walls but he refused. We ended up having to rip up the carpets and had to pay for new flooring for whole of down stairs out of own pocket we also had to pay for paint and had to paint every room in house before moving in. This cost us over all way more than what we owe. But the agency and land lord don't care about this. Also the hot water system in hose does not work properly. You can only get half a bath of hot water a time so when ever we want a bath we have to share bath water. We have complained to land lord but he won't fix it. oh and a few weeks ago the toilet stopped working it would not work. The landlord refused pay and would not send some one to fix it. We had to pay out of are owe pocket for parts and had to fix it our self. The land lord is so Tight. We feel he is treating us badly. What can we do any advice would be much appreciated.Can any one can suggest what I should say to the agency when they come on wednesday. Also can they just throw us out. Im so scared I can't sleep.

I forgot to say and don't know if this effects things but we don't actually have a rental contract as such. When we first started renting We took property on a short term lease. signed a contract (agreement for this) when this ended we asked if we couls stay longer and they said this was fine. We asked them to draw up and send us a new rental agreement (contract) for us to sign. But agency told us they didn't need to and that old one that we signed for the short term lease would be fine
Rudy thats for your response but firstly. Its not a case that we can't afford it its just taking us time to get are sleves sorted. We were fine until my husband lost his job. He did not ask to losse his job, he was made redundent as they were cutting back on staff. Like wise I did not ask to get ill. They amount we are paying is the cheap for the uk, probably the cheapest. The are also no other property around so its not acase of just finding some where else cheaper. I understand what your saying. But I have to say I would not expect to get paid to do nothing. When I pay rent I expect the land lord to fix things. When I moved in, the house should have been habitable. I should not have had to pay out for new flooring for whole of down stairs plus paint. Surely this is the landlords responsibility to make sure the house they are renting is habitable.
